Caregivers are the people who know the children better than anyone in the system. Caregivers raise the children and\u00a0are with them 24\/7, whereas the social worker may only see them once a month and the\u00a0<span style=\"line-height: inherit;\">CASA may only see them once a week.\u00a0<\/span><\/p>\n<p>Both federal and state law recognizes the importance of foster parents\u2019 participation in juvenile court proceedings and require information sharing with caregivers. Federal law requires that foster parents and other caregivers receive expanded opportunities for notice, the right to participate in dependency court review and permanency hearings, and the right to communicate concerns to the courts. State law similarly provides that caregivers may submit their concerns to courts in writing. On October 26, 2021 the California Department of Social Services published an All County Information Notice in order to \"remind county child welfare service agencies...of the requirement to provide the caregiver with a hearing notice and a Caregiver Information Form (JV-290 form) and JV-290 Instruction Sheet for Caregiver Information Form (JV-290 INFO) that the caregiver may complete and submit I-87-21<\/a><span style=\"color: #ffffff;\">a<\/span><\/p>\n<\/div>\n\t<\/div>\n<\/div>\n<div class=\"fl-module fl-module-rich-text fl-node-5e4e6cc18fe8a\" data-node=\"5e4e6cc18fe8a\">\n\t<div class=\"fl-module-content fl-node-content\">\n\t\t<div class=\"fl-rich-text\">\n\t<h3 class=\"code-cite\">Basic Information All Resource Parents Should Have<\/h3>\n<p>When the agency places a child, the caregiver is provided with a \"caregiver placement agreement.\" \u00a0This agreement should contain the basic information needed for the caregiver to provide for that child's needs while placed in their care, including all of the following:<\/p>\n<ul>\n<li style=\"text-align: left;\">The name, mailing address, telephone number, and facsimile number of the child\u2019s social worker and the social worker\u2019s supervisor.\u00a0<span style=\"color: #28aeb3;\"><a style=\"color: #28aeb3;\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=16503.5.&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code\u00a0\u00a7 16503.5(d)<\/a><\/span>AND <a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=16010.4.&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code\u00a0\u00a7 16010.4 (d)(1)<\/a><\/li>\n<li>The name, mailing address, telephone number, and facsimile number of the child\u2019s attorney and court-appointed special advocate (CASA), if any.\u00a0<a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=16010.4.&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code\u00a0\u00a7 16010.4 (d)(2)<\/a><\/li>\n<\/ul>\n<p style=\"padding-left: 25px;\"><span style=\"text-decoration: underline;\">NOTE<\/span>:\u00a0 The minor's attorney is required to provide his or her contact information to the child's caregiver no later than 10 days after receipt of the caregiver's contact information.\u00a0 If the child is 10 years or older, his or her attorney must provide that contact info directly to the child no later than 10 days after receipt of the caregiver's contact information. \u00a0<a style=\"font-family: system-ui, '---apple-system', BlinkMacSystemFont, Code\u00a0\u00a7 16010.4 (d)(3)<\/a><\/li>\n<li>The case number assigned to the child\u2019s juvenile court case.\u00a0<a (d)(4)<\/a><\/li>\n<li>A copy of the child\u2019s birth certificate, passport, or other identifying documentation of age as may be required for enrollment in school and extracurricular Child Welfare Act (ICWA)<\/span><\/strong>: \u00a0It is imperative that everyone - attorneys, social workers, the court -\u00a0ask whether a foster child may have Indian heritage at the very beginning of a dependency case. If ICWA is not followed the case may be overturned or invalidated at any stage, including post finalization of an adoption. As a foster parent or relative caregiver, you know the most about the child's current circumstances and needs, and should provide any information or concerns you may have to the juvenile court. The goal is to enable the judge to make informed decisions about the child and reach the best outcome regarding the disposition of the child. You may use the JV-290 to describe the child and alert the court to potential placement disruptions, visitation issues, and any unmet needs.<\/p>\n<p>The JV-290 form may be submitted in connection with court review hearings, which are held every six months, starting with the \"6-month review hearing.\" For more information regarding review hearings, please visit our <a href=\"https:\/\/adevine.io\/advokids-backup\/juvenile-court-process\/\" target=\"_blank\" rel=\"noopener noreferrer\">Dependency Court Process page<\/a>.<\/p>\n<p>Foster parents in California have fought to pass legislation to ensure your right to attend\u00a0review hearings, file a JV-290, and play an active role in the juvenile court process. Even if your Foster Family Agency files a JV-290, we recommend that you file one as well.<\/p>\n<p>When completing the <a href=\"http:\/\/www.courts.ca.gov\/documents\/jv290.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">JV-290 Caregiver Information Form<\/a>, be sure to be factual, provide specific information, and remain child-centered, positive and kind. You may also want to:<\/p>\n<ul>\n<li>Attach a photo so the judge can put a beautiful, smiling face to a name and file number.<\/li>\n<li>Report all the positive developments in the child\u2019s life and the progress made.<\/li>\n<li>Share any concerns or individual needs the child may have that are or are not being met.\u00a0 We encourage caregivers to reach out to medical providers to advocate for the child's mental and physical health.\u00a0 You can use this sample\u00a0<a href=\"https:\/\/adevine.io\/advokids-backup\/..\/wp-content\/uploads\/2018\/09\/Pediatrician-Letter-add-to-Caregiver-page.pdf\">Request for Medical Services letter<\/a>\u00a0to contact pediatricians, mental health professionals and any other providers who treat the child.<\/li>\n<li>If possible, attach letters from doctors, teachers, or other professionals to support your concerns or requests for services. If you have attachments, be sure to check the box on item 12, indicate the total number of pages attached, and include the date and the case number.\u00a0Label each attachment page \u201cAttachment to JV-290, <em>Date<\/em>, <em>Case Number<\/em>.\u201d<\/li>\n<li>The court is required by law to \"consider the report and recommendation\" included in the JV-290 \"prior to determining any disposition.\" \u00a0<a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=366.21&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7\u00a0366.21(d)<\/a><\/li>\n<\/ul>\n<p id=\"t4\">When you file your JV-290, you are also developing\u00a0a relationship with your juvenile court judge and all other\u00a0parties involved with the case. Your JV-290 will become a part of the court file and will reflect your dedication and commitment to the child. You should file JV-290s\u00a0faithfully and consistently prior to every review hearing, starting with the six-month hearing. Down the road, if you need to solicit assistance from the\u00a0juvenile court regarding your child, your JV-290 Forms will\u00a0help the judge track your participation in review hearings and will show how hard you have worked on behalf of the child in your care. JV-290 Forms should be filed two weeks before the scheduled review hearing.<\/p>\n<p>For your benefit, the Judicial Council also\u00a0created the <a href=\"http:\/\/www.courts.ca.gov\/documents\/jv290info.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">JV-290 Instruction Sheet<\/a>, which provides detailed instructions for filling out and filing the JV-290. You will find the forms below.<\/p>\n<p><span style=\"color: #ffffff;\">a60<\/span><\/p>\n<h4>Filing Your JV-290 in Person at the Courthouse<\/h4>\n<p>At least five calendar days before the hearing, bring your completed JV-290 form with copies to the Juvenile Court Clerk's office for filing.\u00a0 The court filing clerk will sometimes make copies for you but we advise you to bring additional copies just in case (some counties only require 1 or 2 additional copies, some you need to bring 8).\u00a0 The clerk will then distribute, or \"serve\" your JV-290 to all of the relevant people involved in the case.\u00a0 \u00a0Be sure to keep one copy stamped \"filed\" by the Clerk, for your records. \u00a0<a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_534\" target=\"_blank\" rel=\"noopener\">California Rules of Court, Rule 5.534(k)(6)<\/a><\/p>\n<p id=\"t5\">Make sure to bring the following documents with you:<\/p>\n<ul>\n<li>A copy of\u00a0<a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_534\" target=\"_blank\" rel=\"noopener noreferrer\">California Rule of Court, Section 5.534(k)<\/a>\u00a0This law establishes your right to file the JV-290 and the court clerk\u2019s duty to serve it on all other parties on your behalf.<\/li>\n<li><a href=\"http:\/\/www.courts.ca.gov\/documents\/jv290info.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">JV-290 Instruction Sheet\u00a0<\/a><\/li>\n<li><a href=\"http:\/\/www.courts.ca.gov\/documents\/jv290.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">JV-290 Caregiver Information Fillable Form<\/a>. Bring the original and 8 copies, with attachments and photos, so the Juvenile Court Clerk may serve the necessary parties.\u00a0 In some counties, such as Los Angeles, the clerk only requires 2 additional copies.\u00a0 You may call the clerk's office to confirm how many copies you should bring for filing.<\/li>\n<li>Any attachments that may be on a <a href=\"http:\/\/www.courts.ca.gov\/documents\/mc030.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">MC-030 Declaration Fillable Form<\/a><\/li>\n<li><a href=\"http:\/\/www.courts.ca.gov\/documents\/jv287.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">JV-287 Confidential Information Fillable Form<\/a>. You may use Form JV-287 in order to keep confidential any contact information listed on the JV-290.<\/li>\n<\/ul>\n<p><span style=\"color: #ffffff;\">a70<\/span><\/p>\n<h4>Filing Your JV-290 by Mail<\/h4>\n<p>At least seven days prior to the hearing date, mail your completed JV-290 form with attachments to the juvenile court filing clerk's office (where the hearing will be held).\u00a0 Include however many copies required in your envelope (default is 8 unless you call beforehand and confirm the clerk only requires 1-2 copies).\u00a0 Include a cover letter indicating the mailing is for \"filing and service\" and that you request a \"file-endorsed\" copy returned in the self-addressed stamped envelope you have provided. The clerk is responsible for providing copies of your form to all parties and completing the proof of service.<\/p>\n<p>&nbsp;<\/p>\n<h4><b>E-Filing Your JV-290<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">You have the option to e-file your JV-290 in the following counties:<\/span><\/p>\n<ul>\n<li><a href=\"http:\/\/www.lacourt.org\/division\/efiling\/efiling2.aspx\"><span style=\"font-weight: 400;\">Los Angeles County<\/span><\/a><\/li>\n<li><a href=\"https:\/\/www.riverside.courts.ca.gov\/FormsFiling\/ESubmit\/esubmit.php\"><span style=\"font-weight: 400;\">Riverside County<\/span><\/a><\/li>\n<li>During the pandemic, Orange County will facilitate caregiver filing of the JV-290 caregiver's info form.
