Foster Family Agencies are also accountable to the Juvenile Court.<\/p>\n<p id=\"t3\">California state law and Federal law allow and encourage caregivers to have Juvenile Court access and Juvenile Court reporting power. In California, we have an additional reporting opportunity which allows \u201cany interested person\u201d to request a change of court order under very specific circumstances.<\/p>\n<p>Communicating with the court requires special court forms and protocol. County agencies must file reports and recommendations to the Juvenile Court at the time of disposition, review hearings, and permanency planning hearings.<\/p>\n<p>Advokids encourages all foster child advocates to always report their <span style=\"text-decoration: underline;\">serious<\/span> concerns about a child in foster care to the county child welfare agency. Here are a few things you should know about reporting to the county welfare agency:<\/p>\n<ul>\n<li><span class=\"uline\">All<\/span> communications should be <span style=\"text-decoration: underline;\">in writing<\/span>.<\/li>\n<li><span class=\"uline\">All<\/span> correspondence reporting a situation or concern about a child should be sent to the following people:\n<ul class=\"lvl2\">\n<li>Assigned social worker,<\/li>\n<li>His\/Her supervising social worker,<\/li>\n<li>All agency employees responsible for the child, <strong>including the program manager and director<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>It is important to inform all professionals up the chain of command of your concerns. This allows the administrators and directors of the agency to be aware of your concerns and will encourage them to scrutinize the activities and decisions within their department.<\/p>\n<p>Copies of all letters of concern written to the agency should also be sent to:<\/p>\n<ul>\n<li>The child\u2019s attorney<\/li>\n<li id=\"t4\">County counsel<\/li>\n<li>The CASA, if one has been appointed<\/li>\n<li>The Foster Family Agency social worker, Foster Family Agency social worker\u2019s supervisor, and the Director of your Foster Family Agency<\/li>\n<li><a title=\"California Ombudsman For Foster Care\" href=\"http:\/\/www.cdss.ca.gov\/cdssweb\/entres\/forms\/English\/pub379.pdf\">California Ombudsperson for Foster Care<\/a><\/li>\n<\/ul>\n<p><a href=\"https:\/\/adevine.io\/advokids-backup\/..\/wp-content\/uploads\/pdf\/sample_letter_of_concern.pdf\" target=\"_blank\" rel=\"noopener\">Example of letter of concern (pdf)<\/a><\/p>\n<h3>FOSTER FAMILY AGENCIES<\/h3>\n<p>Foster family agencies are also responsible for the day-to-day casework with foster children in California. They have a duty to file periodic reports with the Juvenile Court.<\/p>\n<p>Welfare and Institutions Code Section 366.21 (d) requires that:<\/p>\n<ul>\n<li>Prior to any hearing involving a child in the physical custody of a community care facility or a foster family agency that may result in the return of the child to the physical custody of his or her parent or legal guardian, or in adoption or the creation of a legal guardianship, the facility or agency shall file with the court a report, or a Judicial Council <a href=\"http:\/\/www.courts.ca.gov\/documents\/jv290.pdf\" target=\"_blank\" rel=\"noopener\">Caregiver Information Form (JV-290)<\/a>, containing its recommendation for disposition.<\/li>\n<\/ul>\n<p id=\"t5\" class=\"code-cite\"><a href=\"http:\/\/www.leginfo.ca.gov\/cgi-bin\/displaycode?section=wic&amp;group=00001-01000&amp;file=360-370\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7366.21(d)<\/a><\/p>\n<p>If you are an advocate with a concern about a foster child placed through a Foster Family Agency, be sure to send a letter of concern to the Foster Family Agency social worker, his\/her supervisor and the director of the Foster Family Agency. Copies of all letters of concern written to the FFA should also be sent to all county social workers involved in the child\u2019s case, the director of the county agency, the child\u2019s attorney, county counsel, and the CASA, if one has been appointed.<\/p>\n<h3>ATTORNEYS<\/h3>\n<p>Attorneys charged with the duty of representing foster children in the dependency legal system have a tremendous responsibility. It is important for all child advocates to be familiar with Welfare and Institutions Code Section 317(e), and the state and county rules of court which set out the specific duties and obligations of minor\u2019s counsel.<\/p>\n<p>CALIFORNIA WELFARE AND INSTITUTIONS CODE \u00a7 317(e):<\/p>\n<ul>\n<li>Counsel shall be charged in general with the representation of the child\u2019s interests. To that end, the counsel shall make or cause to have made any further investigations that he or she deems in good faith to be reasonably necessary to ascertain the facts, including the interviewing of witnesses, and he or she shall examine and cross-examine witnesses in both the adjudicatory and dispositional hearings.<\/li>\n<li>He or she may also introduce and examine his or her own witnesses, make recommendations to the court concerning the child\u2019s welfare, and participate further in the proceedings to the degree necessary to adequately represent the child.<\/li>\n<li>In any case in which the child is four years of age or older, counsel shall interview the child to determine the child\u2019s wishes and to assess the child\u2019s well-being, and shall advise the court of the child\u2019s wishes.<\/li>\n<li>Counsel for the child shall not advocate for the return of the child if, to the best of his or her knowledge, that return conflicts with the protection and safety of the child. In addition counsel shall investigate the interests of the child beyond the scope of the juvenile proceeding and report to the court other interests of the child that may need to be protected by the institution of other administrative or judicial proceedings.<\/li>\n<li>The attorney representing a child in a dependency proceeding is not required to assume the responsibilities of a social worker and is not expected to provide nonlegal services to the child. The court shall take whatever appropriate action is necessary to fully protect the interests of the child.<\/li>\n<\/ul>\n<p class=\"code-cite\"><a href=\"http:\/\/www.leginfo.ca.gov\/cgi-bin\/displaycode?section=wic&amp;group=00001-01000&amp;file=305-324.5\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7317(e)<\/a><\/p>\n<p>Attorneys representing children in dependency court are also held to \u201cminimum standards of representation\u201d under <a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\" target=\"_blank\" rel=\"noopener\">California Rules of Court Section 5.660<\/a>.<\/p>\n<p>Some counties also have \u201cLocal Rules of Court\u201d requiring more specified duties of minor\u2019s counsel beyond the requirements or standards of representation required by Welfare and Institutions Code \u00a7 317(e), above, and <a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\" target=\"_blank\" rel=\"noopener\">California Rule of Court \u00a7 5.660<\/a>.\u00a0<a href=\"http:\/\/www.courts.ca.gov\/3027.htm\" target=\"_blank\" rel=\"noopener\">Local Rules of Court, by County (pdf)<\/a><\/p>\n<p><a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\" target=\"_blank\" rel=\"noopener\">California Rule of Court 5.660<\/a> also requires a process for the review and resolution of complaints or questions by a party regarding the performance of an appointed attorney<\/p>\n<p>In some California counties, a complaint concerning the performance of an attorney appointed to represent a minor may be lodged on the child\u2019s behalf by a caretaker, relative, or a foster parent.
