The county child welfare agencies are accountable to the dependency courts as they propose initial case dispositions and review hearing case dispositions. Foster Family Agencies are also accountable to the dependency court.<\/p>\n<p id=\"t3\" class=\"_mPS2id-t mPS2id-target mPS2id-target-last\">California state law and Federal law allow and encourage caregivers to have dependency court access and dependency court reporting power. In California, we have an additional reporting opportunity which allows \u201cany interested person\u201d to request a change of court order under very specific circumstances.<\/p>\n<p><span style=\"text-decoration: underline;\">If you are a Caregiver<\/span>:\u00a0 Communicating with the court requires special court forms and protocol. If you are a caregiver and wish to report to the court at the time of a review hearing, you will need to file a <a href=\"http:\/\/www.courts.ca.gov\/documents\/jv290.pdf\">JV-290 Caregiver Information form<\/a>.\u00a0 For more information, please see our <a title=\"Information For Caregivers (JV-290)\" href=\"https:\/\/adevine.io\/advokids-backup\/legal-tools\/information-for-caregivers\/information-for-caregivers-jv-290\/\">Caregiver Information page<\/a>.<\/p>\n<p><span style=\"text-decoration: underline;\">If you are not a party or a Caregiver<\/span>:\u00a0if you are not a party to the juvenile dependency case and not a caregiver of the dependent child you have concerns about, you will need to file a <a href=\"http:\/\/www.courts.ca.gov\/documents\/jv180.pdf\">JV-180 Request to Change Court Order form<\/a> to communicate with the court.\u00a0 For more information on how to utilize this form, please see our\u00a0<a title=\"How to Request to Change a Court Order (JV-180 to 184)\" href=\"https:\/\/adevine.io\/advokids-backup\/legal-tools\/information-for-caregivers\/how-to-request-to-change-a-court-order-jv-180-to-184\/\">Request to Change a Court Order page<\/a>.<\/p>\n<h3 id=\"reportaconcern\" class=\"_mPS2id-t\">Reporting A Concern About a Foster Child or Youth in Your Care<\/h3>\n<p>If you have serious concerns about a foster child or youth that is placed in your care, it is important to keep all communication about your concerns <span style=\"text-decoration: underline;\">in writing<\/span> so that you can document who you have voiced the concerns to.\u00a0County child welfare agencies are responsible for the day-to-day casework for foster children in California. County agencies must file reports and recommendations to the dependency court at the time of disposition, review hearings, and permanency planning hearings.\u00a0 Advokids encourages all foster child advocates to always report their serious concerns about a child in foster care to the county child welfare agency.\u00a0 It is important to inform all professionals up the chain of command of your concerns. They have a duty to file periodic reports with the Juvenile Court. \u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=366.21&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7 366.21 (d)<\/a> requires that:<\/p>\n<p>Prior to any hearing involving a child in the physical custody of a community care facility or a foster family agency that may result in the return of the child to the physical custody of his or her parent or legal guardian, or in adoption or the creation of a legal guardianship, the facility or agency shall file with the court a report, or a Judicial Council <a href=\"http:\/\/www.courts.ca.gov\/documents\/jv290.pdf\" target=\"_blank\" rel=\"noopener\">Caregiver Information Form (JV-290)<\/a>, containing its recommendation for disposition. \u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=366.21&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7 366.21(d)<\/a><\/p>\n<p>If you are an advocate with a concern about a foster child placed through a Foster Family Agency, be sure to send a letter of concern to the Foster Family Agency social worker, his\/her supervisor and the director of the Foster Family Agency. Copies of all letters of concern written to the FFA should also be sent to all county social workers involved in the child\u2019s case, the director of the county agency, the child\u2019s attorney, county counsel, and the CASA, if one has been appointed.<\/p>\n<p><a id=\"t4\" class=\"_mPS2id-t\"><\/a><span style=\"color: #ffffff;\">t4<\/span><\/p>\n<h3 id=\"reportfosteryouthviolation\" class=\"_mPS2id-t\">Reporting Foster Youth Rights Violations to the Ombudsperson<\/h3>\n<p>If your complaint is related to the care, placement, services, or rights of a foster child or youth, you can contact the California State Ombudsperson for Foster Care.<\/p>\n<p>The California Ombudsperson for Foster Care is the state agency mandated to investigate and attempt to resolve complaints, on behalf of foster children, related to their care, placement or services. The office is empowered to investigate complaints about state and local agencies regarding foster care. Please be aware that this is a very serious step to take. If no action is taken in response to your complaint, you will have to continue to work with the social worker about whom you complained.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The names of county directors, addresses, and telephone numbers are listed in the County Government section of the local telephone directory or you may also find this information by visiting the County Welfare Directors Association website at <\/span><a href=\"http:\/\/www.cwda.org\/membership\"><span style=\"font-weight: 400;\">www.cwda.org\/membership<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><a id=\"t4\"><\/a><span style=\"color: #ffffff;\">t4<\/span><\/h3>\n<div id=\"jcp\">\n<h3 id=\"complaintsaboutjudges\" class=\"_mPS2id-t\">Complaints About California Judges for Misconduct or Wrongdoing<\/h3>\n<p><span style=\"font-weight: 400;\">Complaints about California judges should be made in writing to the Commission on Judicial Performance. You may use the Commission's complaint form or write a letter describing the judge's conduct. (A complaint form can be obtained by calling the phone number for the Commission shown below). Written complaints should include the name of the judge, relevant dates, names of witnesses, and sources of information. Copies (do not send originals) of court documents may be attached to your letter to support the allegations against the judge. It is important for all child advocates to be familiar with <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=317&amp;lawCode=WIC\">Welfare and Institutions Code Section 317(e)<\/a>, and the state and county rules of court which set out the specific duties and obligations of minor\u2019s counsel.\u00a0 Attorneys representing children in dependency court are also held to \u201cminimum standards of representation\u201d under <a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\" target=\"_blank\" rel=\"noopener\">California Rule of Court <\/a><a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a><a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\" target=\"_blank\" rel=\"noopener\"> 5.660<\/a>.\u00a0 Some counties also have \u201clocal rules of court\u201d requiring more specified duties of minor\u2019s counsel beyond the requirements or standards of representation required by <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=317&amp;lawCode=WIC\">Welfare and Institutions Code \u00a7 317(e)<\/a>\u00a0and <a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\" target=\"_blank\" rel=\"noopener\">California Rule of Court \u00a7 5.660<\/a>.\u00a0 Please check our <a href=\"https:\/\/adevine.io\/advokids-backup\/local-rules\/\">Local Rules by County webpage<\/a> to identify any rules applicable in your county.<\/p>\n<p><a href=\" http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\" target=\"_blank\" rel=\"noopener\">California Rule of Court <\/a><a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\" target=\"_blank\" rel=\"noopener\">\u00a7<\/a><a href=\" http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\" target=\"_blank\" rel=\"noopener\">\u00a05.660<\/a> also requires a process for the review and resolution of complaints or questions by a party regarding the performance of an appointed attorney.<\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">\"Attorneys or their agents are expected to meet regularly with clients, including clients who are children, regardless of the age of the child or the child's ability to communicate verbally, to contact social workers and other professionals associated with the client's case, to work with other counsel and the court to resolve disputed aspects of a case without contested hearing, and to adhere to the mandated timelines. The attorney for the child must have sufficient contact with the child to establish and maintain an adequate and professional attorney-client relationship. The attorney for the child is not required to assume the responsibilities of a social worker and is not expected to perform services for the child that are unrelated to the child's legal representation.\"\u00a0 <\/span><a href=\"https:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\"><span style=\"font-weight: 400;\">California Rules of Court, Rule 5.660(d)(4)<\/span><\/a><\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_660\"><span style=\"font-weight: 400;\">Rule 5.660(e)<\/span><\/a><span style=\"font-weight: 400;\"> further mandates a complaint procedure for appointed attorneys in which the court must take action.\u00a0 If you believe that your court-appointed attorney is not representing your interests, you can report problems or lodge complaints to the presiding judge of the juvenile court by using the \u201c<\/span><a href=\"https:\/\/adevine.io\/advokids-backup\/wp-content\/uploads\/2016\/03\/ADVOKIDS-REQUEST-FOR-ASSISTANCE-CA-ATTORNEY.pdf\"><span style=\"font-weight: 400;\">Request for Assistance with Court Appointed Attorney<\/span><\/a><span style=\"font-weight: 400;\">\u201d form.\u00a0 You may find <\/span><a href=\"https:\/\/adevine.io\/advokids-backup\/wp-content\/uploads\/2017\/08\/Instructions-for-Form.pdf\"><span style=\"font-weight: 400;\">instructions for completing the form here<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0 If you know your judge's name or department, you can address the letter to that judge and send your letter there.\u00a0 If you do not know who your judge is, try searching online for the supervising or presiding judge of the juvenile dependency court in the county your case is in.\u00a0 If you can't find out who that is, address your letter to \"Supervising Juvenile Dependency Judge\" and send it to the juvenile dependency court in the county that has jurisdiction over the case.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4>For Individuals who are not Parties to the Juvenile Dependency Case<\/h4>\n<p><span style=\"font-weight: 400;\">If you are not a party complaining about your court appointed attorney, only certain counties have adopted Local Rules of Court which allow adults who have a relationship with a child in foster care to lodge a complaint on behalf of the child, i.e. the caregiver, social worker, CASA, or relative. See your county <\/span><a href=\"https:\/\/www.courts.ca.gov\/3027.htm\"><span style=\"font-weight: 400;\">Local Rules<\/span><\/a><span style=\"font-weight: 400;\">, under \u201cRepresentation of Parties: Complaints.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You can find the contact information for the presiding judge of the juvenile dependency case in this <\/span><a href=\"https:\/\/adevine.io\/advokids-backup\/wp-content\/uploads\/_FORMS\/ADVOKIDS-DIRECTORY-OF-JUVENILE-JUDGES.pdf\"><span style=\"font-weight: 400;\">directory of mailing addresses<\/span><\/a><span style=\"font-weight: 400;\"> for all juvenile court presiding judges in the State of California.<\/span><\/p>\n<h3><a id=\"t4\"><\/a><span style=\"color: #ffffff;\">t4<\/span><\/h3>\n<h4>Complaint of Attorney Misconduct with the State Bar of California<\/h4>\n<p><span style=\"font-weight: 400;\">Another recourse if you encounter problems with a court appointed attorney is to contact the State Bar of California and file a complaint for any unethical professional conduct.\u00a0 If you are filing a complaint about a court appointed minor\u2019s attorney, a complaint may be made on behalf of a minor.
