target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7 319(f)(2)<\/a><\/p>\n<p>This term includes a parent, sibling, grandparent, aunt, uncle, nephew, niece, great-grandparent, great-aunt or great uncle (grandparents\u2019 sibling), first cousin, great-great grandparent, great-great-aunt or great great uncle (great-grandparents\u2019 sibling), first cousin once removed (parent\u2019s first cousin), and great-great-great-grandparent; a step-parent or step-sibling; and the spouse or domestic partner of any of the people described above, even if the marriage or partnership was terminated by death or dissolution.\u00a0 <a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&linkid=rule5_502\" target=\"_blank\" rel=\"noopener\">California Rule member\u201d is defined as an adult caregiver who has an established familial relationship with a relative of the child or a familial or mentoring relationship with the child. The county welfare department shall verify the existence of a relationship through interviews with the parent and child or with one or more third parties. The parties may include relatives of the child, teachers, medical professionals, clergy, neighbors, and family friends. \u00a0<a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=362.7&lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare & Institutions Code \u00a7<\/a><a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=362.7&lawCode=WIC\">\u00a7<\/a><a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=362.7&lawCode=WIC\">\u00a0362.7,<\/a>\u00a0<a County Placing Agency\u2019s Role and Legal Obligations<\/span>\n\t<\/h3>\n\t<\/div>\n<\/div>\n<div class=\"fl-module fl-module-accordion fl-node-5a0cc9acc9720\" data-node=\"5a0cc9acc9720\">\n\t<div class=\"fl-module-content fl-node-content\">\n\t\t<div class=\"fl-accordion fl-accordion-small\" role=\"tablist\" multiselectable=\"true\">\n\t\t<div class=\"fl-accordion-item \" >\n\t\t<div aria-controls=\"fl-accordion-5a0cc9acc9720-panel-0\"><h4><li>Conduct an Investigation to Identify and Locate Relatives<\/li><\/h4><\/a>\n\n\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cc9acc9720-icon-0\" class=\"fl-accordion-button-icon\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cc9acc9720-panel-0\"><i class=\"fl-accordion-button-icon fl-accordion-button-icon-right fas fa-plus\"><span class=\"sr-only\">Expand<\/span><\/i><\/a>\n\t\t\t\n\t\t<\/div>\n\t\t<div class=\"fl-accordion-content fl-clearfix\" id=\"fl-accordion-5a0cc9acc9720-panel-0\" aria-labelledby=\"fl-accordion-5a0cc9acc9720-tab-0\" aria-hidden=\"true\" role=\"tabpanel\" aria-live=\"polite\"><p>Within 30 days of a child\u2019s removal from the home of his or her parent or guardian, if the child is in, or at risk of, entering foster care, the social worker must use due diligence in conducting an investigation to identify and locate the following adult relatives:<\/p>\n<ul>\n<li>ALL grandparents<\/li>\n<li>ALL parents of a sibling of the child, if the parent has legal custody of that sibling<\/li>\n<li>ALL adult siblings<\/li>\n<li>Other adult relatives of the child, including any other adult relatives suggested by the parents or child (who are important to him\/her)<\/li>\n<li>If it is known or there is reason to know the child is an Indian child, then any extended family members as defined under the <a href=\"https:\/\/adevine.io\/advokids-backup\/legal-tools\/indian-child-welfare-act-icwa\/\">Indian Child Welfare Act<\/a>.<\/li>\n<\/ul>\n<p>This policy underscores the importance of relative participation and support in all aspects of a child\u2019s life. The social worker is not required to notify a relative whose personal history of family or domestic violence would make notification inappropriate. \u00a0<a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=WIC\u00a7ionNum=309\">Welfare &amp; Institutions Code \u00a7 309(e),<\/a>\u00a0<a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_637\">California Rule of Court 5.637<\/a><\/p>\n<\/div>\n\t<\/div>\n\t\t<div class=\"fl-accordion-item \" >\n\t\t<div class=\"fl-accordion-button\"  id=\"fl-accordion-5a0cc9acc9720-tab-1\" aria-selected=\"false\" aria-controls=\"fl-accordion-5a0cc9acc9720-panel-1\" aria-expanded=\"false\" role=\"tab\" tabindex=\"0\">\n\n\t\t\t\n\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cc9acc9720-label-1\" class=\"fl-accordion-button-label\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cc9acc9720-panel-1\"><h4><li>Provide Written Notice to All Adult Relatives Located by County<\/li><\/h4><\/a>\n\n\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cc9acc9720-icon-1\" class=\"fl-accordion-button-icon\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cc9acc9720-panel-1\"><i class=\"fl-accordion-button-icon fl-accordion-button-icon-right fas fa-plus\"><span class=\"sr-only\">Expand<\/span><\/i><\/a>\n\t\t\t\n\t\t<\/div>\n\t\t<div class=\"fl-accordion-content fl-clearfix\" id=\"fl-accordion-5a0cc9acc9720-panel-1\" aria-labelledby=\"fl-accordion-5a0cc9acc9720-tab-1\" aria-hidden=\"true\" role=\"tabpanel\" aria-live=\"polite\"><p>Within 30 days of removal of the child, the county social worker shall provide both written and oral notification (when appropriate) to all identified\/located adult relatives of the child.\u00a0 The notice must include\u00a0all of the following information:<\/p>\n<ul>\n<li>The child has been removed.<\/li>\n<li>Explanation of the various options to participate in the care and placement of the child and support for the child\u2019s family, including any options that may be lost by failing to respond.<\/li>\n<li>How to become a <a href=\"https:\/\/adevine.io\/advokids-backup\/resource-family-approval-rfa-program\/\">Resource Family<\/a>.\u00a0 *<span style=\"text-decoration: underline;\">NOTE<\/span>: An interested relative MUST apply to be a resource family but can request placement pending approval.<\/li>\n<li>Information about providing care for the child while the family receives reunification services with the goal of returning the child to the parent or guardian.<\/li>\n<li>Services and support that are available to people caring for children in placement.<\/li>\n<li>A copy of\u00a0<a href=\"http:\/\/www.courts.ca.gov\/documents\/jv285.pdf\" target=\"_blank\" rel=\"noopener\">Relative Information (Form JV-285)<\/a>(or\u00a0<a href=\"http:\/\/www.courts.ca.gov\/documents\/jv285s.pdf\" target=\"_blank\" rel=\"noopener\">Informaci\u00f3n del pariente, JV-285S)<\/a>, with the county and address of the court, the child\u2019s name and date of birth, and the case number already entered in the appropriate caption boxes by the social worker.<\/li>\n<li>A copy of\u00a0<a href=\"http:\/\/www.courts.ca.gov\/documents\/jv287.pdf\" target=\"_blank\" rel=\"noopener\">Confidential Information Form JV-287<\/a>, which may be used to keep contact information confidential.<\/li>\n<li>The court clerk must provide the social worker, all unrepresented parties, and all attorneys with a copy of the completed form or letter.<\/li>\n<\/ul>\n<p><a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=309.&amp;lawCode=WIC\">Welfare &amp; Institutions Code\u00a0\u00a7\u00a7 309(e)(1)<\/a>,\u00a0<a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=628&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">628(d);<\/a>\u00a0<a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_534\" target=\"_blank\" rel=\"noopener\">California Rule of Court 5.534(f)<\/a><\/p>\n<\/div>\n\t<\/div>\n\t\t<div class=\"fl-accordion-item \" >\n\t\t<div class=\"fl-accordion-button\"  id=\"fl-accordion-5a0cc9acc9720-tab-2\" aria-selected=\"false\" aria-controls=\"fl-accordion-5a0cc9acc9720-panel-2\" aria-expanded=\"false\" role=\"tab\" tabindex=\"0\">\n\n\t\t\t\n\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cc9acc9720-label-2\" class=\"fl-accordion-button-label\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cc9acc9720-panel-2\"><h4><li>Initiate Assessment if Emergency Placement is Requested by Relative or NREFM<\/li><\/h4><\/a>\n\n\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cc9acc9720-icon-2\" class=\"fl-accordion-button-icon\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cc9acc9720-panel-2\"><i class=\"fl-accordion-button-icon fl-accordion-button-icon-right fas fa-plus\"><span class=\"sr-only\">Expand<\/span><\/i><\/a>\n\t\t\t\n\t\t<\/div>\n\t\t<div class=\"fl-accordion-content fl-clearfix\" id=\"fl-accordion-5a0cc9acc9720-panel-2\" aria-labelledby=\"fl-accordion-5a0cc9acc9720-tab-2\" aria-hidden=\"true\" role=\"tabpanel\" aria-live=\"polite\"><p>If an able and willing relative (or NREFM) is available, s\/he may request that the county agency place the child in his or her home on a temporary\/emergency basis pending approval of the resource family application. \u00a0In other words, a foster child can be placed in that relative (or NREFM)'s home as an emergency placement prior to the detention hearing. \u00a0If a request for emergency placement is made, the county welfare department shall initiate an assessment of the relative's or NREFM's suitability. \u00a0The assessment shall include:<\/p>\n<ul>\n<li>An in-home inspection to assess the safety of the home\u00a0and the ability of the relative or non-relative extended family member to care for the child\u2019s needs<\/li>\n<li>A consideration of the results of a criminal records check<\/li>\n<li>A check of allegations of prior child abuse or neglect concerning the relative or non-relative extended family member and other adults in the home.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displayText.xhtml?lawCode=WIC&amp;division=9.&amp;title=&amp;part=4.&amp;chapter=5.&amp;article=2.\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code section 16519.5(e)<\/a>; Consistent with the legislative intent for children to be placed immediately with a relative, this section does not limit the county social worker\u2019s ability to place a child in the home of a relative or a nonrelative extended family member pending the consideration of other relatives who have requested preferential consideration.\"<\/p>\n<p><a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=WIC&amp;sectionNum=361.3.\">Welfare and Institutions Code section data-node=\"59ef6ee8df778\">\n\t<div class=\"fl-module-content fl-node-content\">\n\t\t<div class=\"fl-rich-text\">\n\t<h3><a id=\"Inquire\"><\/a>The Court's Role at Detention and Disposition:\u00a0 Inquire About Relatives and Make Findings on Agency's Due Diligence in Locating Them<\/h3>\n<p>At the detention hearing the court must ask the parent(s) of the child to provide contact information about maternal and paternal relatives so the social worker can contact them and initiate an assessment if they are willing to be considered for placement. \u00a0The social worker must include in the detention report the results of any assessment of a relative home conducted under \u00a7309(d). \u00a0The agency must also have a procedure for the relatives of a child who has been removed to identify themselves to the social worker and be provided with notice of dependency proceedings.<\/p>\n<p>At the disposition hearing, the court must make findings as to whether the social services agency used due diligence to identify, locate and notify relatives and may order the agency to take additional steps to identify relatives if it finds that the agency has not used due diligence.<br 1-13-21)<\/a>.<\/p>\n<p>The policy reason allowing this type of placement prior to RFA approval is that it is in the best interest of the child to maintain his\/her family or family-like connections and decrease further trauma to that child caused by unnecessary placement disruptions.<\/p>\n<p><span style=\"line-height: inherit;\">For placement on an \"emergency basis\" or for a \"compelling reason,\" the County must conduct an in-home inspection to assess the safety of the home and the ability of the relative or NREFM to care for the child\u2019s needs and complete a California Law Enforcement Telecommunications System background check (CLETS).\u00a0 Within 10 calendar days following the criminal records check conducted through the CLETS or five business days of making the emergency placement, whichever is sooner, the social worker shall ensure that a fingerprint clearance is initiated through the Department of Justice. (For more information, including calendaring, scheduling and confidentiality issues see <a href=\"http:\/\/www.cdss.ca.gov\/lettersnotices\/EntRes\/getinfo\/acl\/2013\/13-27.pdf\">California DSS All County Letter ACL No. 13-27<\/a><\/li>\n<\/ul>\n<p>County agencies are required to use the\u00a0<em>Notice of Action-Denial of Home Assessment\/Approval (<\/em><a href=\"http:\/\/www.cdss.ca.gov\/cdssweb\/entres\/forms\/English\/NA1271.pdf\"><em>NA 1271<\/em><\/a><em>) form<\/em>\u00a0to provide notice of denial and the right to a state hearing to relatives and NREFMs:<\/p>\n<ul>\n<li>To complete the NA 1271 Form, leave the\u00a0fillable areas on page one of the form to be completed by the agency worker. The form is then mailed to the denied applicant, who completes page two and returns it to the CDSS State Hearings Division as indicated on the form.<\/li>\n<li>A copy of the NA 1271 form can also be downloaded in English, Spanish and additional languages\u00a0The fillable areas on the forms have limited space to enter text, so be mindful not to enter too much text and disrupt formatting on the second page.\u2028 If more room is needed, please use an additional page and attach to the Notice.<\/li>\n<li>Please note that the right to a state hearing does not apply to placement decisions. The form can include information about\u00a0your relationship with the child,\u00a0the child\u2019s education or medical needs, and any other information that might be helpful to the court.\u00a0Form JV-285 may be submitted at any time during the court process.<\/p>\n<p>See our\u00a0<a href=\"https:\/\/adevine.io\/advokids-backup\/legal-tools\/juvenile-court-process\/\">Juvenile Court Process page<\/a>.<\/p>\n<p>When completing the\u00a0<a href=\"http:\/\/www.courts.ca.gov\/documents\/jv285.pdf\">Relative Information Form (Form JV-285)<\/a>, be sure to be factual, provide specific information, and remain child-centered, positive and kind. You may also want to:<\/p>\n<ul>\n<li>Attach a photo so the judge can put a beautiful, smiling face to a name and file number.<\/li>\n<li>Share any concerns or individual needs the child may have.<\/li>\n<li>If possible, attach letters from doctors, teachers, or other professionals to support your concerns. If you have attachments, be sure to check the box on item 12, indicate the total number of pages attached, and include the date and the case number. Label each attachment page \u201cAttachment to Form JV-285,\u00a0<em>Date<\/em>,\u00a0<em>Case Number<\/em>.\u201d<\/li>\n<li>Submit the original Form JV-285 with 8 copies of the form (each form should have a photo on it) to the Juvenile Court Clerk\u2019s Office at least five calendar days before the hearing (or seven days if filing by mail). The County Clerk will then distribute, or \"serve\" your Form JV-285 to all of the relevant people involved in the case.<br \/>\n<a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_534\">California Rules of Court \u00a7 5.534 .<br \/>\n<\/a>Some clerk offices will copy Form JV-285 for you, but we recommend coming prepared with all 8 copies just in case.<\/li>\n<li>Be sure to keep one copy stamped \"filed\" by the Clerk, for your records.<\/li>\n<li>You have the option to e-file your JV-285 in the following counties:\n<ul style=\"list-style-type: disc;\">\n<li><a href=\"http:\/\/www.lacourt.org\/division\/efiling\/efiling2.aspx\">Los Angeles County<\/a><\/li>\n<li><a href=\"https:\/\/www.riverside.courts.ca.gov\/FormsFiling\/ESubmit\/esubmit.php\">Riverside County<\/a><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">Other counties may also offer e-filing in their juvenile divisions.\u00a0 If you are in a different county and wish to e-file, you should call the court clerk\u2019s office to learn whether the juvenile court currently accepts submissions by e-file.\u00a0 Be sure to specify that you are inquiring about filing in juvenile court, as counties may permit e-filing in other courts, but not the juvenile division.<\/span><span style=\"font-weight: 400;\">\u00a0 <\/span><\/p>\n<p>When you file your Form JV-285, you are also developing a relationship with your juvenile court judge and all other parties involved with the case. Your Form JV-285 will become a part of the court file and will reflect your dedication and commitment to the child.\u00a0 You may use Form\u00a0<a href=\"http:\/\/www.courts.ca.gov\/documents\/jv287.pdf\">JV-287<\/a>\u00a0in order to keep confidential any contact information listed on Form JV-285.<br \/>\n<a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_534\">California Rule of Court 5.534(f)(2)<\/a><\/p>\n<\/div>\n\t<\/div>\n\t\t<div class=\"fl-accordion-item \" >\n\t\t<div class=\"fl-accordion-button\"  id=\"fl-accordion-5a0ccf2a59a4d-tab-5\" aria-selected=\"false\" aria-controls=\"fl-accordion-5a0ccf2a59a4d-panel-5\" aria-expanded=\"false\" role=\"tab\" tabindex=\"0\">\n\n\t\t\t\n\t\t\t<a href=\"#\" id=\"fl-accordion-5a0ccf2a59a4d-label-5\" class=\"fl-accordion-button-label\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0ccf2a59a4d-panel-5\"><h4><li>File JV-180 Request to Change Court Order<\/li><\/h4><\/a>\n\n\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion-5a0ccf2a59a4d-icon-5\" class=\"fl-accordion-button-icon\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0ccf2a59a4d-panel-5\"><i class=\"fl-accordion-button-icon fl-accordion-button-icon-right fas fa-plus\"><span class=\"sr-only\">Expand<\/span><\/i><\/a>\n\t\t\t\n\t\t<\/div>\n\t\t<div class=\"fl-accordion-content fl-clearfix\" id=\"fl-accordion-5a0ccf2a59a4d-panel-5\" aria-labelledby=\"fl-accordion-5a0ccf2a59a4d-tab-5\" aria-hidden=\"true\" role=\"tabpanel\" aria-live=\"polite\"><p>Any person who has an interest in a dependent child of the juvenile court (including relatives and\/or NREFMs) can request a hearing before a judge under Welfare and Institutions Code section 388. \u00a0<a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=388&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener noreferrer\">Welfare and Institutions Code section 388<\/a>\u00a0specifically states any parent or \"other person\" having\u00a0an interest in a child who is a dependent child of the juvenile court (even when you are not a party and do not qualify for de facto status) may petition the court for a change of court order using a JV-180 form.\u00a0<\/p>\n<div>\n<p>You should file a form called the JV-180 Request to Change Court Order for important issues that need to be addressed immediately. Specifically, the JV-180 is appropriate when (1)\u00a0an immediate hearing is required; (2)\u00a0circumstances have changed or there is new evidence that you can offer to the judge; (3)\u00a0it is in the child\u2019s best interests to modify a previous order; and\/or (4)\u00a0you seek visits, placement, or contact with a dependent sibling in foster care, or on behalf of a child who has a sibling in foster care. \u00a0<a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=388&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener noreferrer\">Welfare and Institutions Code \u00a7 388<\/a><a href=\"http:\/\/www.courts.ca.gov\/cms\/rules\/index.cfm?title=five&amp;linkid=rule5_570\">; California Rule of Court 5.570(e)<\/a><\/p>\n<p>For additional information\u00a0please visit our <a href=\"https:\/\/adevine.io\/advokids-backup\/legal-tools\/information-for-caregivers\/how-to-request-to-change-a-court-order-jv-180-to-184\/\">Jv-180 page<\/a>.\u00a0<\/p>\n<\/div>\n<\/div>\n\t<\/div>\n\t<\/div>\n\t<\/div>\n<\/div>\n\t<\/div>\n<\/div>\n\t<\/div>\n\t\t<\/div>\n\t<\/div>\n<\/div>\n<div class=\"fl-row fl-row-full-width fl-row-bg-none fl-node-5a0cd1182d7f9\" data-node=\"5a0cd1182d7f9\">\n\t<div class=\"fl-row-content-wrap\">\n\t\t<div class=\"uabb-row-separator uabb-top-row-separator\" >\r\n<\/div>\r\n\t\t\t\t\t\t<div class=\"fl-row-content fl-row-full-width fl-node-content\">\n\t\t\n<div class=\"fl-col-group fl-node-5a0cd11844279\" data-node=\"5a0cd11844279\">\n\t\t\t<div class=\"fl-col fl-node-5a0cd11844967\" data-node=\"5a0cd11844967\">\n\t<div class=\"fl-col-content fl-node-content\">\n\t<div id=\"rel4\" class=\"fl-module fl-module-heading fl-node-5a0cd112af1de\" data-node=\"5a0cd112af1de\">\n\t<div class=\"fl-module-content fl-node-content\">\n\t\t<h3 class=\"fl-heading\">\n\t\t<span class=\"fl-heading-text\">Relative and\/or NREFM Placement Considerations<\/span>\n\t<\/h3>\n\t<\/div>\n<\/div>\n<div class=\"fl-module fl-module-accordion fl-node-5a0cd1487ea06\" data-node=\"5a0cd1487ea06\">\n\t<div class=\"fl-module-content fl-node-content\">\n\t\t<div class=\"fl-accordion fl-accordion-small\" role=\"tablist\" multiselectable=\"true\">\n\t\t<div class=\"fl-accordion-item \" >\n\t\t<div class=\"fl-accordion-button\"  id=\"fl-accordion-5a0cd1487ea06-tab-0\" aria-selected=\"false\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-0\" aria-expanded=\"false\" role=\"tab\" tabindex=\"0\">\n\n\t\t\t\n\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-label-0\" class=\"fl-accordion-button-label\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-0\"><h4><li>Relatives Have Placement Preference<\/li><\/h4><\/a>\n\n\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-icon-0\" class=\"fl-accordion-button-icon\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-0\"><i class=\"fl-accordion-button-icon fl-accordion-button-icon-right fas fa-plus\"><span class=\"sr-only\">Expand<\/span><\/i><\/a>\n\t\t\t\n\t\t<\/div>\n\t\t<div class=\"fl-accordion-content fl-clearfix\" id=\"fl-accordion-5a0cd1487ea06-panel-0\" aria-labelledby=\"fl-accordion-5a0cd1487ea06-tab-0\" aria-hidden=\"true\" role=\"tabpanel\" aria-live=\"polite\"><p>Prior to January 1, 2018, certain relatives (grandparents, aunts and uncles) had placement preference over others. \u00a0Currently, there is no longer preferential preference given to any of these relatives. \u00a0Welfare and Institutions Code section 361.3(a) states \"preferential consideration shall be given to a request by a relative of the child for placement of the child with the relative, regardless of the relative's immigration status.\" \u00a0Subsection (b) now provides that if one more than one relative requests placement, each of those relatives shall be considered under the factors listed in subdivision (a). \u00a0 \u00a0<a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=361.3&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7 361.3(a)-(b)<\/a><\/p>\n<p>If a relative seeks placement under section 361.3 prior to the disposition hearing, the social services agency must consider and investigate the request. (<em>In re R.T.<\/em>\u00a0(2015) 232 Cal.App.4th 1284, 1297.) A relative of the child shall be given preferential consideration. \u201cPreferential consideration\u2019 means that the relative seeking placement shall be the first placement to be considered and investigated.\u201d<br \/>\n<a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=361.3&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7 361.3(c1)<\/a><\/p>\n<p>Preferential consideration \u201cdoes not create an evidentiary presumption in favor of a relative, but merely places the relative at the head of the line when the court is determining which placement is in the child\u2019s best interests.\u2019 (<em>In re Sarah S.<\/em>\u00a0(1996) 43 Cal.App.4th 274, 286.) The Court realizes \u201cthe importance of according relatives a \u2018fair chance\u2019 to obtain custody. (<em>Cesar V. v. Superior Court<\/em>\u00a0(2001) 91 Cal.App.4th 1023.) At the same time, however,\u00a0<strong><em>the fundamental duty of the juvenile court is to \u2018assure the best interest of the child\u2019<\/em><\/strong>\u00a0\u2026. [emphasis added].\u201d (<em>In re Stephanie M.\u00a0<\/em>(1994) 7 Cal.4th 295.)<\/p>\n<p>The relative placement preference does not \u201coperate as an evidentiary presumption in favor of placement with [relatives] that would overcome the juvenile court\u2019s duty to\u00a0<u>determine the best interests of the child<\/u>\u2026 The relative placement preference is not a relative placement\u00a0<em>guarantee <\/em>[emphasis added].\u201d(<em>In re Joseph T.<\/em>\u00a0(2008) 163 Cal.App.4th 787.)<\/p>\n<\/div>\n\t<\/div>\n\t\t<div class=\"fl-accordion-item \" >\n\t\t<div class=\"fl-accordion-button\"  id=\"fl-accordion-5a0cd1487ea06-tab-1\" aria-selected=\"false\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-1\" aria-expanded=\"false\" role=\"tab\" tabindex=\"0\">\n\n\t\t\t\n\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-label-1\" class=\"fl-accordion-button-label\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-1\"><h4><li>Relative Placement Factors<\/li><\/h4><\/a>\n\n\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-icon-1\" class=\"fl-accordion-button-icon\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-1\"><i class=\"fl-accordion-button-icon fl-accordion-button-icon-right fas fa-plus\"><span class=\"sr-only\">Expand<\/span><\/i><\/a>\n\t\t\t\n\t\t<\/div>\n\t\t<div class=\"fl-accordion-content fl-clearfix\" id=\"fl-accordion-5a0cd1487ea06-panel-1\" aria-labelledby=\"fl-accordion-5a0cd1487ea06-tab-1\" aria-hidden=\"true\" role=\"tabpanel\" aria-live=\"polite\"><p>Welfare and Institutions Code section 361.3, subdivision (a) sets forth a number of factors the agency and the court must consider in deciding to place the child with a relative.\u00a0 \"In determining whether placement with a relative is appropriate, the county social worker and court shall consider, but shall not be limited to, consideration of all the following factors:<\/p>\n<ol>\n<li>The best interest of the child, including special physical, psychological, educational, medical, or emotional needs.<\/li>\n<li>The wishes of the parent, the relative and the child, if appropriate.<\/li>\n<li>The provisions of Part 6 (commencing with Section 7950) of Division 12 of the Family Code regarding relative placement.<\/li>\n<li>Placement of siblings and half-siblings in the same home, if that placement is found to be in the best interest of each of the children as provided in Section 16002.<\/li>\n<li>The good moral character of the relative and any other adult living in the home, including whether any individual residing in the home has a prior history of violent criminal acts or has been responsible for acts of child abuse or neglect.<\/li>\n<li>\u00a0The nature and duration of the relationship between the child and the relative, and the relative\u2019s desire to care for the child.<\/li>\n<li>The ability of the relative to do the following:<\/li>\n<\/ol>\n<p style=\"padding-left: 60px;\">(A) \u00a0Provide a safe, secure, and stable environment for the child<\/p>\n<p style=\"padding-left: 60px;\">(B) \u00a0Exercise proper and effective care and control of the child<\/p>\n<p style=\"padding-left: 60px;\">(C) \u00a0Provide a home and the necessities of life for the child.<\/p>\n<p style=\"padding-left: 60px;\">(D) \u00a0Protect the child from his or her parents.<\/p>\n<p style=\"padding-left: 60px;\">(E) \u00a0Facilitate court-ordered reunification efforts with the parents<\/p>\n<p style=\"padding-left: 60px;\">(F) \u00a0Facilitate visitation with the child\u2019s other relatives.<\/p>\n<p style=\"padding-left: 60px;\">(G) \u00a0Facilitate implementation of all elements of the case plan.<\/p>\n<p style=\"padding-left: 60px;\">(H) \u00a0(i) \u00a0Provide legal permanence for the child if reunification fails.<\/p>\n<p style=\"padding-left: 90px;\">(ii) \u00a0However, any finding made as to (G) or (H) shall not be the sole basis for precluding preferential placement with a relative.<\/p>\n<p style=\"padding-left: 60px;\">(I) \u00a0Arrange for appropriate and safe child care, as necessary<\/p>\n<p style=\"padding-left: 30px;\">8. \u00a0The safety of the relative\u2019s home which must first be approved per Welfare & Institutions Code \u00a7 309 (d).(i.e. an assessment which includes the ability of the relative to meet the child\u2019s needs, a home inspection, and a criminal record check, and the relative home shall meet the same standards and regulations set forth for the licensing a of foster family homes.)\"<br \/> <a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=361.3&lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7 361.3<\/a><\/p>\n<p>While the social services agency is responsible for making the initial assessment of whether a child should be placed with a relative, both the county social worker\u00a0<em>and\u00a0<\/em>the court must consider whether the proposed relative placement is appropriate. If there is an issue concerning a proposed relative placement the juvenile court must use its independent judgment in making its decision. \u00a0It may not just rely on the agency\u2019s recommendation. (<em>Cesar V. v Superior Court<\/em>\u00a0(2001) 91 Cal.App.4th 1023, 1033.)<\/p>\n<\/div>\n\t<\/div>\n\t\t<div class=\"fl-accordion-item \" >\n\t\t<div class=\"fl-accordion-button\"  id=\"fl-accordion-5a0cd1487ea06-tab-2\" aria-selected=\"false\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-2\" aria-expanded=\"false\" role=\"tab\" tabindex=\"0\">\n\n\t\t\t\n\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-label-2\" class=\"fl-accordion-button-label\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-2\"><h4><li>Key Placement Consideration: Best Interest of the Child<\/li><\/h4><\/a>\n\n\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-icon-2\" class=\"fl-accordion-button-icon\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-2\"><i class=\"fl-accordion-button-icon fl-accordion-button-icon-right fas fa-plus\"><span class=\"sr-only\">Expand<\/span><\/i><\/a>\n\t\t\t\n\t\t<\/div>\n\t\t<div class=\"fl-accordion-content fl-clearfix\" id=\"fl-accordion-5a0cd1487ea06-panel-2\" aria-labelledby=\"fl-accordion-5a0cd1487ea06-tab-2\" aria-hidden=\"true\" role=\"tabpanel\" aria-live=\"polite\"><p>It is no coincidence that the child\u2019s best interests are listed as the first factor to be considered in assessing a proposed relative placement. The fundamental duty of the juvenile court throughout dependency proceedings is to determine what is in the best interests of the child.\u00a0 <a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=361.3&lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7 361.3<\/a><\/p>\n<p>Whenever the court contemplates a placement or a change in placement, the court must consider whether that placement would be in the child\u2019s best interest. (<em>In re Stephanie M.\u00a0<\/em>(1994) 7 Cal.4th 295, 321; see also\u00a0<em>Alicia B. \u00a0Superior Court\u00a0<\/em>(2004) 116 Cal.App.4th 856, 862-863 [\u201cThe linchpin of a section 361.3 analysis is whether a placement with a relative is in the best interests of the minor.\u201d];\u00a0<em>\u00a0In re Jessica G.\u00a0<\/em>(1997) 58 Cal.App.4th 1, 8 [best interest is \u201cimplied throughout dependency law\u201d];\u00a0<em>In re Tabatha G,\u00a0<\/em>(1996) 45 Cal.App.4th 1150, 1165 [best interest is \u201cinherent in the legislative procedure\u201d]; \u00a0<em>In re Robert L.\u00a0<\/em>(1993) 21 Cal.App.4th 1057, 1068 [\u201cThe child\u2019s best interest must be the linchpin of the court\u2019s analysis under \u00a7 361.3\u201d].)<\/p>\n<p>The juvenile court is not required to place with relatives unless it finds that it is in the best interest of the child to do so. (<em>Alicia B. v. Superior Court\u00a0<\/em>(2004) 116 Cal.App.4th 862-863.) \u00a0Preferential consideration of a relative \u201cdoes not create an evidentiary presumption in favor of a relative, but merely places the relative at the head of the line when the court is determining which placement is in the child\u2019s best interests.\u201d (<em>In re Sarah S.\u00a0<\/em>(1996) 43 Cal.App.4th \u00a0274, 286.) Section 361.3 does not \u201csupply an evidentiary presumption that placement with a relative is in the child\u2019s best interests,\u201d but it does require the social services agency and juvenile court to determine whether such a placement is appropriate, taking into account multiple factors including the best interests of the child, the parents\u2019 wishes and the fitness of the relative. (<em>In re R.T.\u00a0<\/em>(2015) 232 Cal.App.4th 1284.) Even when the preference applies, it does not \u201covercome the juvenile court\u2019s duty to determine the best interest of the child.\u201d (<em>In re Stephanie M.\u00a0<\/em>(1994) 7 Cal.4th 295, 318-319.)<\/p>\n<\/div>\n\t<\/div>\n\t\t<div class=\"fl-accordion-item \" >\n\t\t<div class=\"fl-accordion-button\"  id=\"fl-accordion-5a0cd1487ea06-tab-3\" aria-selected=\"false\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-3\" aria-expanded=\"false\" role=\"tab\" tabindex=\"0\">\n\n\t\t\t\n\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-label-3\" class=\"fl-accordion-button-label\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-3\"><h4><li>After Disposition and During Reunification: Relative Placement Preference Applies Only When A New Placement is Necessary<\/li><\/h4><\/a>\n\n\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-icon-3\" class=\"fl-accordion-button-icon\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-3\"><i class=\"fl-accordion-button-icon fl-accordion-button-icon-right fas fa-plus\"><span class=\"sr-only\">Expand<\/span><\/i><\/a>\n\t\t\t\n\t\t<\/div>\n\t\t<div class=\"fl-accordion-content fl-clearfix\" id=\"fl-accordion-5a0cd1487ea06-panel-3\" aria-labelledby=\"fl-accordion-5a0cd1487ea06-tab-3\" aria-hidden=\"true\" role=\"tabpanel\" aria-live=\"polite\"><p>Welfare and Institutions Code Section 361.3 further specifies that subsequent to the disposition hearing, <em>whenever a new placement must be made, <\/em>consideration shall again be given to relatives who have not been found to be unsuitable, and who will fulfill the child\u2019s reunification or permanent plan requirements. \u00a0In addition to the factors described in subdivision (a), the social worker shall consider \u201cwhether the relative has established and maintained a relationship with the child.\u201d<\/p>\n<p><a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=361.3&amp;lawCode=WIC\" target=\"_blank\" rel=\"noopener\">Welfare and Institutions Code \u00a7 361.3(d) (<em>emphasis added<\/em>)<\/a><\/p>\n<p>There is a divergence in the case law as follows:<\/p>\n<p><strong><em>Majority View: \u00a0After Disposition The Child\u2019s Placement Should Not be Changed Unless Necessary Because of the Risk of Emotional Damage When A Child\u2019s Primary Attachment is Disrupted.<\/em><\/strong><\/p>\n<p>The majority of cases have held that the relative placement preference applies up to and at the child\u2019s initial disposition hearing, but \u201cdoes not arise again until a new placement of the child must be made.\u201d (<em>In re N.V.\u00a0<\/em>(2010) 189 Cal.App4th 25, 31;\u00a0<em>In re Lauren R.\u00a0<\/em>(2007) 148 Cal.App.4th 841, 854). \u00a0In situations where a relative does not come forward until after disposition, i.e., after a child has been placed with a foster parent or other caregiver, several California courts have held that the maintenance of existing attachment to a primary caregiver is an important consideration in determining the best interests of the child. \u00a0These cases rely on the psychological concept of attachment and the neuroscience of early child development, both of which stress the important role of consistent relationships in young children\u2019s brain development.<\/p>\n<p>In\u00a0<em>In re Lauren Z,\u00a0<\/em>the court focused on the bond between Lauren, the foster child, and her foster parents holding that \u201cLauren, now about three years old, bonded with her foster parents. \u00a0Fanny [the maternal aunt], notwithstanding her apparent financial security and the dependency court\u2019s urging, did not visit and remained a stranger. \u00a0Under these circumstances, Lauren\u2019s best interests have to prevail over all other considerations, and those interests are plainly served only by adoption by her foster parents.\u201d In\u00a0<em>Lauren R.\u00a0<\/em>the court held that \u201cthe overriding concern dependency proceedings, however, is not the interest of the extended family members but the interest of the child\u201d and recognized that \u201cthe passage of time is a significant factor in a child\u2019s life; the longer a successful placement continues, the more important the child\u2019s need for continuity and stability becomes in the evaluation of her best interests.\u201d\u00a0<em>In re Lauren Z.\u00a0<\/em>(2008) 158 Cal.App.4th 1102.<\/p>\n<p>In\u00a0<em>In re Sarah S<\/em>\u00a0the court stated that \u201c[i]t would be grossly unfair and unjust to Sarah to have her bear the detrimental consequences of replacement\u2026[Sarah] is innocent of all that has happened and deserves only what is in her best interests irrespective of the conduct of others.\u201d (<em>In re Sarah S. <\/em>(1996) 43 Cal.App.4th \u00a0274, 287).<\/p>\n<p>In\u00a0<em>In re Rose G<\/em>\u00a0the court stressed that \u201c[a]n important element that a trial court must consider, when making a decision about children, is the impact of the passage of time. \u00a0Childhood is short; many basic attitudes and capacities are developed in the very early years. \u00a0Ties are formed to the adults present in the child\u2019s life, and can only be broken by inviting emotional disaster.\u201d (<em>In re Rose G.\u00a0<\/em>(1976) 57 Cal.App.3d 406, 425).<\/p>\n<p>Child welfare experts now emphasize the need for judges and attorneys to consider the child\u2019s attachment to the current caregiver when determining a child\u2019s best interests. \u00a0The newest research on infant mental health tells us that babies require permanence in their relationships and consistency in their daily routines. \u00a0Consistent early relationships and experiences are the foundation upon which all subsequent emotional development rests\u2026[\u00b6] Consistency in relationships for infants is achieved through attachment \u2013 the formation of an enduring emotional bond with a primary or small number of stable, responsive, and sensitive caregivers. \u00a0Infants in foster care are at particular risk for attachment disruption. \u00a0Decisions to remove infants from their home or move them once in a placement must reflect these needs.\u201d<\/p>\n<p><a href=\"https:\/\/www.nycourts.gov\/ip\/justiceforchildren\/PDF\/Infant%20Booklet.pdf\" target=\"_blank\" rel=\"noopener\">Dicker and Gordon,\u00a0<em>Ensuring the Healthy Development of Infants in Foster Care: \u00a0A Guide for Judges, Advocates, and Child Welfare,<\/em><em>\u00a0<\/em><\/a>New York State Permanent Judicial Commission on Justice for Children, January 2004, pp. 17, 20.<\/p>\n<p>\u201cSecure and stable attachments with a primary caregiver form the foundation for a child\u2019s social, emotional, and cognitive development. \u00a0Children who develop secure attachments show a greater capacity for self-regulation, effective social interactions, self-reliance, and adaptive coping skills later in life\u2026\u201d\u00a0 <a href=\"http:\/\/www.americanbar.org\/content\/dam\/aba\/administrative\/child_law\/visitation_brief.authcheckdam.pdf\" target=\"_blank\" rel=\"noopener\">Smariga,\u00a0<em>Visitation with Infants and Toddlers in Foster Care: What Judges and Attorneys Need to Know<\/em><em>\u00a0<\/em><\/a>(July 2007), ABA Center on Children and the Law Practice and Policy Brief, pp. 4, 5, 8, 11, 12.<\/p>\n<p>\u201cHealthy development depends on the quality and reliability of a young child\u2019s relationship with the important people in his or her life, both within and outside the family. \u00a0Even the development of a child\u2019s brain architecture depends on the establishment of these relationships.\u201d\u00a0 <a href=\"http:\/\/developingchild.harvard.edu\/wp-content\/uploads\/2004\/04\/Young-Children-Develop-in-an-Environment-of-Relationships.pdf\" target=\"_blank\" rel=\"noopener\">National Scientific Council on the Developing Child,\u00a0<em>Young Children Develop in an Environment of Relationships: \u00a0Working Paper No. 1.<\/em><em>\u00a0<\/em>Center for the Developing Child, Harvard University, 2004, p.1.\u00a0<\/a><\/p>\n<p>In any custody determination, a primary consideration in determining the child\u2019s best interests is the goal of assuring stability and continuity. \u00a0\u201cWhen custody continues over a significant period, the child\u2019s need for continuity and stability assumes an increasingly important role. \u00a0That need will often dictate the conclusion that maintenance of the current arrangement would be in the best interest of the child. (<em>In re Stephanie M.\u00a0<\/em>(1994) 7 Cal.4th 296, 317.)<\/p>\n<p><strong><em>Minority View: The Court May Order Placement With A Relative During the Reunification Period So Long As It Is In The Childs Best Interests to Do So<\/em><\/strong><\/p>\n<p>A few cases have held that the court may order placement with a relative post-disposition and during the reunification period if it is in the child\u2019s best interests to do so, regardless of whether a new placement for the child is needed.<\/p>\n<p>In\u00a0<em>Joseph T.<\/em>\u00a0the court was divided on whether the relative placement preference only applies after disposition if a placement change is necessary. \u00a0The majority held that the relative placement preference applies throughout the reunification period, regardless of whether a new placement is necessary or is otherwise being considered by the dependency court. \u00a0(<em>In re Joseph T<\/em>163 Cal.App.4th 787,\u00a0797-798.) \u00a0However the majority still recognized that placement with a relative seeking placement is not automatic, is not guaranteed, and must still be in the best interests of the child. \u00a0(<em>Id.\u00a0<\/em>at 798.) The dissenting opinion concluded that section 361.3 (d) specifically applies to placement changes after disposition and to interpret the statute as applying throughout the entire reunification period would render subdivision (d) meaningless and superfluous, (<em>Id.<\/em>\u00a0at 799.) This dissenting justice as also \u201cconcerned that a contrary interpretation of the statute will result in increased burdens on the child welfare agencies, who will be forced to expend resources on assessments throughout the reunification period, even when the child remains for a substantial period of time in a stable foster care placement.\u201d<\/p>\n<p>The\u00a0<em>Joseph T.\u00a0<\/em>majority relied upon three older cases to support its conclusion that the relative placement preference applies through the family reunification period. \u00a0Advokids believes that these cases do not support the interpretation of the statute that allows relative placement even when a new placement is not being considered after Disposition and prior to termination of parental rights.<\/p>\n<p>In\u00a0<em>In re Sara S<\/em>. the court\u00a0<em>held<\/em>\u00a0that \u201cunder section 361.3 a \u2018relative\u2019 is given priority over others regarding\u00a0<em>the order in which applications for placement are processed\u2026<\/em>[S]ection 361.3 assures interested relatives that, when a child is taken from her parents and placed outside the home pending the determination whether reunification is possible,\u00a0<em>the relative\u2019s application will be considered before a stranger\u2019s application. Sarah S.\u00a0<\/em>does\u00a0<em>not\u00a0<\/em>conclude that a relative\u2019s application for placement\u00a0<em>after\u00a0<\/em>a child has already been placed in a suitable home warrants preferential consideration or is a reason for a placement change. \u00a0(<em>In re Sarah S.\u00a0<\/em>(1996) 43 Cal.App.4th 274, 285-286 (italics added)).<\/p>\n<p>In\u00a0<em>Jessica Z.,\u00a0<\/em>the court\u2019s holding was much more circumscribed than the\u00a0<em>Joseph T.\u00a0<\/em>majority\u2019s conclusion: \u201cwhen, as here, however, a relative requests custody while reunification efforts are still ongoing,\u00a0<em>and before any substantial damage would be done to the child by a change in placement,\u00a0<\/em>we conclude section 361.3 mandates that the propriety of such a placement at least be assessed.\u201d \u00a0In fact, like the\u00a0<em>Joseph T.\u00a0<\/em>majority the\u00a0<em>Jessica Z.\u00a0<\/em>court affirmed the juvenile court\u2019s order denying a placement change, concluding that, because Jessica had been with her foster family for over a year and the option to reunify with parents was becoming increasingly unlikely, it would not be in Jessica\u2019s best interests to move her to the home of a relative who did not come forward until six months after disposition.\u00a0<em>In re Jessica Z.\u00a0<\/em>(1990) 225 Cal.App.3d 1089, 1100.<\/p>\n<p>In\u00a0<em>Baby Girl D,\u00a0<\/em>the issue on appeal was whether relatives who came forward\u00a0<em>after\u00a0<\/em>parental reunification efforts had failed and the court had selected adoption as the permanent plan were entitled to a placement preference for adoption. \u00a0<em>Baby Girl D.\u00a0<\/em>did<em>not\u00a0<\/em>hold that the relative preference applies throughout the reunification period regardless of whether a new placement is necessary. \u00a0<em>In re Baby Girl D.\u00a0<\/em>(1989) 108 Cal.App.3d 1489, 1492-93.<\/p>\n<p><em>Joseph T.\u00a0<\/em>majority\u2019s conclusion to the contrary, neither the statute nor the weight of local authority requires that relatives be given preference after disposition unless a placement change is necessary.<\/p>\n<\/div>\n\t<\/div>\n\t\t<div class=\"fl-accordion-item \" >\n\t\t<div class=\"fl-accordion-button\"  id=\"fl-accordion-5a0cd1487ea06-tab-4\" aria-selected=\"false\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-4\" aria-expanded=\"false\" role=\"tab\" tabindex=\"0\">\n\n\t\t\t\n\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-label-4\" class=\"fl-accordion-button-label\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-4\"><h4><li>End of Reunification Efforts: Relative Placement Preference Ends When Reunification Efforts End (Except when a Placement Change is Necessary or the Agency has Failed\/Refused to Assess Relatives Who Sought Placement Before Disposition)<\/li><\/h4> <\/a>\n\n\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-icon-4\" class=\"fl-accordion-button-icon\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-4\"><i class=\"fl-accordion-button-icon fl-accordion-button-icon-right fas fa-plus\"><span class=\"sr-only\">Expand<\/span><\/i><\/a>\n\t\t\t\n\t\t<\/div>\n\t\t<div class=\"fl-accordion-content fl-clearfix\" id=\"fl-accordion-5a0cd1487ea06-panel-4\" aria-labelledby=\"fl-accordion-5a0cd1487ea06-tab-4\" aria-hidden=\"true\" role=\"tabpanel\" aria-live=\"polite\"><p>The initial focus after a child has been removed from parental custody \u201cis on the parent\u2019s relationship with the child and, when possible, reunification.\u201d \u00a0(<em>In re Sarah S.\u00a0<\/em>(1996) 43 Cal.App. 4th 274, 284.) \u00a0Relatives are given placement preference at disposition because \u201ca relative, who presumably has a broader interest in family unity, is more likely than a stranger to support the parent-child relationship.\u00a0<em>\u00a0<\/em>(<em>Cesar V v Superior Court\u00a0<\/em>(2001) 92 Cal.App.4th 1023, 1032.)<\/p>\n<p>Once the juvenile court has determined that reunification is not possible and reunification efforts are terminated, the very reason for giving relative\u2019s preference \u2013 to maintain family ties \u2013 terminates as well. \u00a0(<em>Sarah S., supra,\u00a0<\/em>43 Cal.App.4th at p.285;\u00a0<em>Lauren R., supra,\u00a0<\/em>148 Cal. App. 4th at pp 854-55.) \u201cApplication of the relative placement preference \u2018requires\u2026factors that are wholly or largely irrelevant once parental rights are terminated. \u00a0By its own terms, therefore section 361.3 applies when \u2018a child is removed from the physical custody of his or her parents,\u2019 and thus must be \u2018placed\u2019 in a temporary home, not when reunification efforts have failed and a permanent plan for adoption has been approved (or when a child has otherwise been freed for adoption.\u201d \u00a0(<em>Sarah S., supra,\u00a0<\/em>43 Cal.App.4th at 284.)<\/p>\n<p>The relative placement preference does not apply to permanent placements or placements for adoption. \u00a0(<em>Lauren R., supra.\u00a0<\/em>148 Cal.App.4th at 174.) The one exception is when a placement change becomes necessary after reunification services are terminated. \u00a0(<em>Cesar V., supra.,\u00a0<\/em>91 Cal.App.4th at 1032.) \u00a0Once the case is in the permanency planning stage, the child\u2019s best interests become paramount.<\/p>\n<p>While the overarching goal of dependency law is to safeguard the welfare of dependent children and to promote their best interests, the law\u2019s first priority when dependency proceedings are commenced is to preserve family relationships. \u00a0To this end, the law requires the juvenile court to provide reunification services unless a statutory exception applies. In contrast, after reunification services are terminated or bypassed \u201cthe parents\u2019 interest in the care, custody and companionship of the child is no longer paramount. Rather, at this point \u2018the focus shifts to the needs of the child for permanency and stability\u2019\u201d \u00a0(<em>In re K.C.\u00a0<\/em>(2011) 52 Cal.4th 231,236, citing\u00a0<em>Stephanie M., supra,\u00a0<\/em>7 Cal.4th at 317.)<\/p>\n<p>One of the earliest cases on relative placement is\u00a0<em>Baby Girl D.<\/em>, which the court held that there is no relative preference at the permanency planning stage. \u00a0(<em>In re Baby Girl D.\u00a0<\/em>(1989) 108 Cal.App.3d 1489, 1493). \u00a0The mother in that case appealed from a post permanent plan order continuing placement in a foster-adoptive home, arguing that the child should have been place with a great aunt who first came forward at the hearing at which services were terminated and the agency directed to file a petition to terminate parental rights. (<em>Id.\u00a0<\/em>at 1492.) \u00a0The court held that \u201c[o]nce the juvenile court determines at a permanency planning hearing that reunification is no longer possible and that a child should be freed for adoption, there is no longer any reason to give relatives preferential consideration in placement. \u00a0The overriding concern at this point is to provide a stable, permanent home in which a child can develop a lasting emotional attachment to his or her caregivers\u2026It would be contrary to Legislative policy to uproot the child and force her to adjust to a new home.\u201d (<em>Id.\u00a0<\/em>at 1494-95.)<\/p>\n<p>In\u00a0<em>Stephanie M.,\u00a0<\/em>the court explained that after termination of reunification services, \u201cthe focus shifts to the needs of the child for permanency and stability, and in fact, there is a rebuttable presumption that continued foster care is in the best interests of the child.\u201d (<em>In re Stephanie M., supra,\u00a0<\/em>7 Cal.4th at\u00a0317.)<\/p>\n<p>The\u00a0<em>Isabella G.\u00a0<\/em>court said\u00a0\u201c[p]rior case law does not preclude the application of the relative placement preference after the reunification period, even when no new placement is necessary.\u201d\u00a0 This is the language upon which relatives who do not come forward in a timely manner rely for the argument that they are entitled to be assessed even after reunification services are terminated. \u00a0However that sentence of\u00a0<em>Isabella G.\u00a0<\/em>was the court\u2019s response to the agency\u2019s argument that the law prohibited the court juvenile court from considering the relative\u2019s placement request at that point in the case in spite of the fact that the relative had\u00a0<em>first requested placement prior to detention. \u00a0<\/em>In\u00a0<em>Isabella G,\u00a0<\/em>because the agency lied to the relative about placement requirements throughout the case and had never actually assessed the relative for placement until the relative filed a section 388 petition after services had been terminated, the court of appeal held that the fact that reunification services had been terminated did not bar the juvenile court from considering the placement request. (<em>In re Isabella G.\u00a0<\/em>(2016) Cal.App.4th 708,\u00a0722-723.) The appellate court noted that\u00a0<em>In re R.T.\u00a0<\/em>had many similarities to this case and quoted\u00a0<em>R.T.\u2019s\u00a0<\/em>holding that the relative placement preference should apply later in a dependency case \u201cwhere the relative invoked the preference\u00a0<em>before\u00a0<\/em>the dispositional hearing [and] the agency and court filed to apply it at disposition\u2026(<em>R.T. supra,\u00a0<\/em>232 Cal.Ap.4th at 1300), \u00a0(<em>Issabella G. supra,\u00a0<\/em>246 Cal.App.4th at 721; emphasis in the original.). The\u00a0<em>Isabella G\u00a0<\/em>court specifically noted, as one of its reasons for rejecting the agency\u2019s arguments, that \u201chad the Agency fulfilled its statutory responsibility when Grandparents first requested placement, their home likely would have been approved\u00a0<em>prior to the dispositional hearing.<\/em>\u201d (<em>Ibid;\u00a0<\/em>emphasis in the original.) Despite arguments to the contrary,\u00a0<em>Isabella G.\u00a0<\/em>does not support the proposition that a relative who did not come forward before disposition but who requests to be considered for placement after reunification services have been terminated must be considered for placement under the provisions of section 361.3.<\/p>\n<\/div>\n\t<\/div>\n\t\t<div class=\"fl-accordion-item \" >\n\t\t<div class=\"fl-accordion-button\"  id=\"fl-accordion-5a0cd1487ea06-tab-5\" aria-selected=\"false\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-5\" aria-expanded=\"false\" role=\"tab\" tabindex=\"0\">\n\n\t\t\t\n\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-label-5\" class=\"fl-accordion-button-label\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-5\"><h4><li>Current Caregiver Preference: The Current Caretaker is the Preferred Adoptive Placement Once Reunification Services are Terminated<\/li><\/h4><\/a>\n\n\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion-5a0cd1487ea06-icon-5\" class=\"fl-accordion-button-icon\" tabindex=\"0\" aria-controls=\"fl-accordion-5a0cd1487ea06-panel-5\"><i class=\"fl-accordion-button-icon fl-accordion-button-icon-right fas fa-plus\"><span class=\"sr-only\">Expand<\/span><\/i><\/a>\n\t\t\t\n\t\t<\/div>\n\t\t<div class=\"fl-accordion-content fl-clearfix\" id=\"fl-accordion-5a0cd1487ea06-panel-5\" aria-labelledby=\"fl-accordion-5a0cd1487ea06-tab-5\" aria-hidden=\"true\" role=\"tabpanel\" aria-live=\"polite\"><p>The current caregiver has specific rights at this stage of the case.\u00a0\u201c[T]he statutory preference for placement of a dependent child with a relative does not apply to a placement made as part of a permanent plan for adoption.\u201d \u00a0(<em>In re Sarah S.\u00a0<\/em>(1996) 43 Cal.App.4th 274, 276-277.) \u00a0\u00a0\u201cOnce reunification efforts have failed, and the juvenile court has before it a proposed permanent plan of adoption it is the caretaker who has preference .\u201d \u00a0(<em>In re M.M.\u00a0<\/em>(2015) 235 Cal.App.4th 54, 63-64.) \u00a0\u00a0The caregiver preference applies anytime the intent is to place the child for adoption. \u00a0(<em>In re Lauren R.\u00a0<\/em>(2007) 148 Cal.App.4th 841.)<\/p>\n<p>In determining adoptive placement, the agency must give current caregiver's preference with respect to their application for adoption. \u00a0Section 366.26 (k) states that \u201cNotwithstanding any other law, the application of any person who, as a relative caretaker or foster parent, has cared for a dependent child for whom the court has approved a permanent plan for adoption or who has been freed for adoption, shall be given preference with respect to that child over all other applications for adoptive placement\u2026\u201d \u00a0Under the terms of the statute, the preference applies if the child has \u201csubstantial emotional ties\u201d to the current caretaker and removal from the current caretaker would be \u201cseriously detrimental to the child\u2019s emotional well-being.\u201d \u00a0The current caregiver\u2019s application must be given \u201cserious and thorough preferential consideration\u201d before the agency may consider an adoptive request from a relative or NREFM who is not the current caretaker.<\/p>\n<p>If the agency believes that it would not be detrimental to the child to remove the child from the current caregiver\u2019s home, the current caretaker is entitled to judicial review of that determination at any hearing on adoptive placement. \u00a0At that hearing, the juvenile court must evaluate the current caretaker for adoptive placement \u201con a level playing field\u201d with a relative. \u00a0(<em>In re Lauren R.\u00a0<\/em>(2007) 148 Cal.App.4th 841, 859-860.)<\/p>\n<p><strong>Prospective Adoptive Parent Status<\/strong><\/p>\n<p>The legislature enacted section 366.26 (n) to limit removals of children from current caregivers who have demonstrated an interest in adopting the child and have cared for the child for at least six months. \u00a0If the caregiver qualifies for the prospective adoptive parent status the agency may not remove the child from the home of a current caregiver without the notice and opportunity to object to the removal required by subdivision (n).\u00a0 The intent was and is to protect the stability and best interests of vulnerable children who are already in prospective adoptive homes when parental rights are terminated.<\/p>\n<p><em>In re M.M., supra,\u00a0<\/em>235 Cal.App.4th 54, 62, which further holds that the agency may not remove a child from the home of a current caregiver who meets the threshold criteria of a prospective adoptive parent even though the section 366.26 yet been held.
